A Ghanaian parent sought custody of two minor children following the breakdown of an international marriage, with the children having been relocated to a European jurisdiction by the other parent without consent — raising urgent Hague Convention issues.

Our Solution

Our family law team coordinated with legal counsel in the relevant European jurisdiction to file an urgent application under the Hague Convention on the Civil Aspects of International Child Abduction. Simultaneously, we obtained a Ghanaian court order preventing further movement of the children and establishing our client's parental rights.

The Result

The children were returned to Ghana within 60 days of our initial filing. Subsequent proceedings resulted in a shared custody arrangement that prioritised the children's welfare, with our client granted primary residence and the other parent receiving defined international access rights.
