A Ghanaian company faced a €3.2 million contractual dispute with a European supplier following the breakdown of a long-term distribution agreement. The supplier claimed damages for wrongful termination; our client counterclaimed for defective goods and loss of business.
Our litigation team undertook detailed analysis of the underlying supply contracts, identified multiple breaches by the supplier predating our client's termination notice, and presented a comprehensive counterclaim. We engaged expert witnesses in both Ghanaian commercial law and European distribution law to support our position.
The dispute was resolved through ICC arbitration in a settlement that was favourable to our client, with the supplier paying a significant portion of our client's claimed losses. Our client's reputation with downstream customers was preserved, and the settlement included a non-disclosure agreement protecting our client's commercial position.
